In December 2019, legislation was passed to modernize the legal framework for the sale, service and delivery of beverage alcohol. The ministry is proposing new regulations under the Act which are meant to streamline information and responsibilities and reduce red tape on businesses. The consultation package includes a paper with details on the proposals and some questions for consideration.
Among the proposals that may be of interest to AMCTO members:
- Currently, municipalities are allowed to prohibit the sale of alcohol in their communities following an organized municipal vote. The proposed regulation would modify this "local option" to no longer allow municipalities that currently permit the sale of alcohol to organize a vote to prohibit the sale of alcohol. The policy rationale provided is so as to protect the existing licensed establishments, manufacturers and retailers that have set up businesses in these areas.
- In the proposed Licensing Regulation, Permits Regulation , s. 151 deals with matters related to restructuring (eg amalgamation and annexation):
- The status under this Act of a municipality that is amalgamated with another municipality that has a different status is not affected by the amalgamation; and may be changed only by a vote under the Act in the municipality amalgamated.
- The status under this Act of a municipality or part of a municipality that is annexed to another municipality that has a different status is not affected by the annexation; and may be changed only by a vote under the Act in the municipality or part annexed
- The day fixed for taking a vote shall be voting day in the next regular election under the Municipal Elections Act, 1996, unless the council, with the approval of the Board, fixes another day and notifies the municipal Clerk. (According to the Act, the Board is the Alcohol and Gaming Commission of Ontario).
